本文聚焦於《群書治要》對漢晉史論中「封建」與「肉刑」兩大議題之選裁
取向,並與貞觀朝相關實政比較,以考察唐初取法周制的政治期許,如何因現實
因素而被調節、轉化。根據研究,《治要》在封建論上對曹魏疏遠宗室、漢晉宗
室勢力過大之隱患均有所反思,而相對肯認曹冏〈六代論〉上繼賈誼所言「眾建
諸侯而少其力」的方案。但貞觀年間封建制旋復旋廢,最終導向的是「有封無
建」之折衷模式;在肉刑論上,則偏向恢復此三代之刑,且聚焦於「中間刑缺
失」困境之討論。但唐初一度復行斬右趾刑後,不久亦被加役流(徒刑及流刑)
的模式所取代,此與《治要》所錄劉頌等人鼓吹恢復肉刑、批評徒刑之情況呈現
理論與實政之張力。同時,魏徵被學界普遍視為《治要》之主編者,但其在上疏
討論封建議題時的個人意見,與《治要》的選錄傾向正好相反,由此衡論,過往
學界對於《治要》之主編者雖具定見,實仍有再探討之餘地。綜而言之,此書在
選裁、反思漢晉史論時,呈現以周代為鏡像的復古傾向,折射出貞觀君臣逾漢邁
晉的政治理想,但在實政層面則仍不免需取法於漢晉形塑之新傳統。
This article examines the Qunshu zhiyao’s selection of Han–Jin historical
discourses on “fengjian” enfeoff ment and corporal punishment, and compares them
with political practice during the Zhenguan reign. It argues that the work reveals
an early Tang aspiration to take Zhou institutions as a normative model, while also
exposing the limits of such classicizing ideals in actual governance.
On “fengjian”, the Qunshu zhiyao refl ects critically on both Cao-Wei alienation
of imperial kinsmen and the excessive power of royal relatives under the Han and
Jin. It gives particular weight to Cao-Jiong’s continuation of Jia-Yi’s proposal to
“establish many feudal lords while reducing their power.” Yet Zhenguan attempts
to revive “fengjian” were soon abandoned, resulting instead in a compromise of
“enfeoffment without territorial establishment.” On corporal punishment, the text
tends to favor restoring the penal practices of the Three Dynasties, especially in
response to the absence of intermediate punishments. In practice, however, the brief
revival of foot-amputation was soon replaced by aggravated exile and penal servitude,
creating a marked tension between theory and policy.
The article further notes that Wei-Zheng’s own memorials on “fengjian” diverge
from the Qunshu zhiyao’s editorial tendency, suggesting that its chief editorship
deserves reconsideration. Overall, the work’s Zhou-oriented vision reflects the
Zhenguan court’s ambition to surpass the Han and Jin, even as its governance
remained indebted to Han–Jin institutional traditions.
